Roady's Terms of Service

Welcome to Roady's. These Terms of Service ("Terms") govern your access to and use of Roady's websites, mobile applications, programs, services, promotions, and related platforms (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
 

1. General Use
Roady's provides programs, tools, information, discounts, rewards opportunities, and related services for independent truck stops, drivers, fleets, vendors, and other users. All Services are offered subject to availability and may be modified, suspended, or discontinued at any time without notice.
 

2. Independent Locations
Roady's is a network of independently owned and operated locations. Each participating truck stop, travel center, or service location is solely responsible for its own operations, pricing, fuel quality, products, services, staffing, hours, safety practices, compliance with law, and customer interactions.
Roady's does not own, operate, control, or manage participating locations unless expressly stated otherwise.
 

3. No Guarantee of Availability
Products, fuel, discounts, rewards, promotions, vendor programs, or services may vary by location and time. Roady's does not guarantee that any offer, product, service, or pricing will be available at every location or at any specific time.

 

4. User Accounts
Certain Services may require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Roady's may suspend or terminate accounts at its discretion.

 

5. Rewards and Promotions
Any rewards, loyalty programs, discounts, sweepstakes, contests, or promotions may be subject to additional rules. Roady's may modify, limit, suspend, or terminate any such program at any time without liability, to the extent permitted by law.

 

6. Third-Party Services
The Services may include links to or integrations with third-party providers, including payment processors, fuel card companies, vendors, software providers, advertisers, or partner locations. Roady's is not responsible for third-party products, services, policies, errors, outages, or conduct.

 

7. Accuracy of Information
Roady's attempts to provide accurate information but does not warrant that any content, maps, pricing, availability, fuel savings estimates, vendor offers, or other materials are complete, accurate, current, or error-free.

 

8. Limitation of Liability
To the maximum extent permitted by law, Roady's, its affiliates, officers, directors, employees, agents, contractors, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business, downtime, fuel loss, towing costs, travel delays, personal injury, property damage, or data loss arising from or related to use of the Services.
Roady's total liability for any claim shall not exceed the amount paid by you directly to Roady's for the specific Service giving rise to the claim in the twelve (12) months preceding the event, or $100, whichever is greater.

 

9. Indemnification
You agree to defend, indemnify, and hold harmless Roady's and its affiliates, officers, employees, agents, and partners from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, misuse of accounts, or interactions with third parties.

10. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

 

11. Prohibited Conduct
Use the Services unlawfully; interfere with system security or operations; misrepresent identity or affiliation; upload malicious code; use automated scraping or unauthorized data collection tools; abuse promotions, discounts, or rewards programs.

 

12. Termination
Roady's may suspend, restrict, or terminate access to the Services at any time, with or without notice, for any reason.

 

13. Governing Law and Venue
These Terms shall be governed by the laws of the State of Idaho, without regard to conflict of law principles. Any dispute shall be brought exclusively in the state or federal courts located in Boise, unless otherwise required by law.

 

14. Arbitration / Class Action Waiver
At Roady's sole election or as otherwise required by applicable law, disputes may be resolved through binding arbitration on an individual basis. You waive participation in class actions or class arbitration to the fullest extent permitted by law.

 

15. Changes to Terms
Roady's may update these Terms at any time by posting revised Terms. Continued use of the Services after changes become effective constitutes acceptance.
